Acceptance of These Terms
These Terms of Use (the "Terms") govern access to and use of highgrounddefense.com (the "Site"), operated by High Ground Defense ("HGD," "we," "us"). By using the Site, you accept these Terms. If you do not agree, do not use the Site.
Informational Purpose; No Offer
The Site provides general information about HGD and its products for government, military, and professional procurement audiences. Nothing on the Site constitutes an offer to sell, a solicitation, a quotation, or a commitment of availability.
HGD products are defense articles controlled under U.S. export law. Any sale or transfer occurs only under a written agreement and only in accordance with applicable U.S. export licensing and authorization requirements, as described in our Export Compliance statement.
Eligibility and Lawful Use
The Site is intended for users 18 years of age or older. You agree to use the Site only for lawful purposes and in compliance with all applicable local, state, federal, and international laws.
Intellectual Property
The Site and its content, including text, images, graphics, logos, and data compilations, are the property of HGD or its licensors and are protected by U.S. and international trademark and copyright law. High Ground Defense, HGD, M134HG, Advantage, and ALPS are trademarks of High Ground Defense. ArmorLube is a registered trademark of its respective owner and is referenced with authorization.
HGD grants you a limited, personal, non-exclusive, non-transferable license to view the Site for informational purposes. No content may be reproduced, distributed, scraped, or used commercially without HGD's prior written consent.
Accuracy of Information
HGD works to keep published specifications and other information accurate and current, but the Site may contain inadvertent errors and information that has been superseded. Specifications, configurations, and availability are subject to change without notice. Site content does not form part of any contract, and authoritative technical and contractual data is provided only through HGD's direct engagement process.
Export Control Notice
Products and technical data referenced on the Site are subject to the International Traffic in Arms Regulations (22 C.F.R. Parts 120-130) and, where applicable, the Export Administration Regulations (15 C.F.R. Parts 730-774). The Site is limited to publicly releasable information. You agree not to interfere with the operation or security of the Site; introduce malicious code; attempt unauthorized access to any HGD system; harvest data from the Site by automated means; or misrepresent your identity, organization, or country in communications with HGD.

TO THE FULLEST EXTENT PERMITTED BY LAW, HGD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO USE OF THE SITE OR RELIANCE ON ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Indemnification
You agree to indemnify and hold HGD harmless from claims, losses, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or misuse of the Site.
Governing Law and Venue
These Terms are governed by the laws of the State of Arizona and applicable federal law, without regard to conflict of laws principles. Any action arising out of these Terms shall be brought in the state or federal courts located in Maricopa County, Arizona, and you consent to the jurisdiction of those courts.
General
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. HGD's failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and Export Compliance statement, are the entire agreement regarding use of the Site. HGD may assign its rights under these Terms; you may not assign yours without HGD's written consent.
Changes
HGD may update these Terms from time to time. Changes take effect when posted, as indicated by the effective date on this page. Continued use of the Site after a change constitutes acceptance.
